Terms and Conditions

1. You must be of legal age to drive and produce a valid UK/Northern Ireland provisional category B driving licence. If an older paper licence is held, then you must also produce a valid passport as photographic identification.

For Pass Plus or Refresher lessons a full valid licence must be produced with identification as above.

You must meet the minimum eye test requirements, which means you must be able to read a standard UK approved number plate at a minimum distance of 20.5 metres (67 feet). If you need to wear glasses or contact lenses in order to meet this requirement then you must wear them whenever you drive.

2. You must notify your instructor of any change of your ability or entitlement to have driving tuition, for example your provisional licence has been revoked or for medical reasons such as epilepsy.

3. If you wish to cancel a lesson, a minimum of 48 hours notice must be given. Failure to give 48 hours notice will the result in the lesson(s) having to be paid for. Lessons can be cancelled by telephone or text message but must be acknowledged by your Instructor. If there are any last minute changes to collection or drop off points this may impact the amount of driving time within the lesson.

4. If your Instructor turns up on time at the pre-arranged pick up point and you do not show, your Instructor will wait 10 minutes, if there is no contact made between you and the Instructor, they will leave and you will have to pay for the lesson.

5. Your Instructor will endeavour to arrive on time however, due to unforeseen circumstances such as breakdown, accidents, traffic hold ups etc, lesson times may need to change or even be cancelled. If cancelled by your Instructor, no fee will be charged and the lessons will be rearranged to the nearest convenient date.

6. Lessons must be paid for in advance or at the time of the lesson by cash or cheque. Your instructor will advise you to whom the cheque should be made payable.

7. You must not be under the influence of drugs/alcohol during the training. In the event of there being any signs of drugs/alcohol misuse, Innov8 Driving School will withhold the use of the training vehicle for use of tuition or driving test until the pupil is in a legal and fit state to drive. Any prescribed medication that may effect your driving should be declared to Innov8 Driving School and to the DVLA medical board.

Should the pupil fail to reach a satisfactory standard of driving and is likely to be a danger to other road users, or is in an unfit condition through substance or alcohol abuse as described above, the ADI has a responsibility to the DVSA examiners not to allow the use of the training vehicle for the purpose of the driving test. This is in the interest of the pupil, the examiner and other road users and is a precautionary safety measure. DVSA guidelines do not allow for a pupil to take a practical test just for the experience.

8. If you are unsuccessful on your driving test you will be required to take a minimum of 1 hours extra training to make sure you have kept up your skills at least a day before your next attempt.

9. No responsibility can be taken for tests cancelled by the DVSA for whatever reason. Lessons will have to be paid for but can be claimed back from the DVSA. The Instructor cannot be responsible if you fail the eyesight test. Your Instructor will be responsible if the test is cancelled due to the condition of the tuition vehicle.

10. No responsibility can be taken by the driving instructor if you break any driving laws while accompanied by your instructor. All fines and penalty points are your responsibility.

11. All Innov8 instructors are self employed and run their own business individually and separately from Innov8. Each instructor books driving lessons individually and Innov8 has no access to these diaries. We also take privacy seriously and any business conducted is between the individual instructor and the student. Any disputes between student and instructor are to be resolved between the individual and the instructor and Innov8 will only act as an intermediary to help resolve any disputes.

12.When using the online booking system the booking is provisional only and be confirmed by the instructor within 48hrs of the booking. We reserve the right to amend or cancel the booking as required. Terms and conditions must be agreed to at the time of the booking

13. When booking a theory test class if the student is under the age of 18 at the time of the booking then a consent form must be filled in by a parent or legal guardian at the time of the booking. Safeguarding rules for minors will be abided to at all times

13a. The student (or parent if the student is under 18) is responsible for their conduct and behaviour during the classes and the tutor reserves the right to remove the student from the class if they deem it necessary and appropriate. No refunds will be made if this occurs and the student will be excluded for any remaining classes.

14. All theory test class booking are payable at the time of the booking and can be amended or cancelled with no charge by either party up to 3 working days before the classes begin. Once the classes have started then no refunds will be made if you decide not to complete the course

Driving Lesson Booking Terms & Conditions

These Terms and Conditions apply to all driving lessons, lesson packages and related services booked through our website, by telephone, by email, or directly with one of our driving instructors.

By booking a driving lesson or purchasing a lesson package, you confirm that you have read, understood and agreed to these Terms and Conditions.

1. Driving Licence Requirements

You must hold a valid UK provisional or full driving licence that entitles you to drive the relevant vehicle.

You must provide your driving instructor with your driving licence details and any information reasonably required to verify your entitlement to drive before your first lesson.

You are responsible for informing your instructor immediately if your licence is suspended, revoked, cancelled or otherwise becomes invalid.

If you are unable to provide evidence of a valid driving licence when requested, the instructor may refuse to conduct the lesson and the lesson may still be chargeable.

2. Fitness to Drive

You must be fit and legally entitled to drive at the time of every lesson.

You must inform your instructor of any medical condition, medication or change in circumstances that may affect your ability to drive safely or legally.

You must not attend a driving lesson while under the influence of alcohol, illegal drugs or any substance that may impair your ability to drive safely.

If your instructor reasonably believes that you are unfit to drive, the lesson may be cancelled immediately. In these circumstances, the lesson may still be charged in full.

3. Online Bookings

All online bookings are subject to instructor availability.

Submitting a booking request does not necessarily guarantee a lesson until the booking has been confirmed through our booking system, by the driving school or by the allocated instructor.

You are responsible for ensuring that all information supplied during the booking process is complete and accurate, including your name, contact information, licence information, transmission preference and collection location.

4. Manual and Automatic Lessons

Where applicable, you must select whether you require manual or automatic driving lessons.

We will allocate an instructor according to the transmission type selected and instructor availability.

Please check your booking carefully. We cannot guarantee that an alternative vehicle or instructor will be available if the incorrect transmission type has been selected.

5. Lesson Payments

Lesson prices will be displayed at the time of booking or confirmed with you before your lesson.

Payment may be required in advance when booking online.

Where payment is due before a lesson, your booking may not be confirmed until payment has been successfully received.

We reserve the right to amend our lesson prices. Any price changes will not normally affect individual lessons that have already been booked and paid for.

6. Lesson Packages

Where you purchase a block or package of driving lessons, the number of hours shown represents the amount of driving tuition purchased.

Any indication of the number of lessons or hours a learner may require is an estimate only. Every learner progresses at a different rate, and purchasing a particular package does not guarantee that you will reach test standard within those hours.

Additional lessons may therefore be recommended or required.

Lesson packages are personal to the learner who purchased them and may not be transferred to another person unless we agree otherwise in writing.

7. Cancellation and Rescheduling

If you need to cancel or rearrange a driving lesson, you must provide at least 48 hours’ notice before the scheduled start time.

Where less than 48 hours’ notice is provided, we reserve the right to charge the full lesson fee or deduct the lesson from a prepaid package.

Where sufficient notice is provided, we will make reasonable efforts to rearrange the lesson subject to instructor availability.

Exceptional circumstances may be considered at our discretion.

8. Late Arrival and Failure to Attend

Please be ready at the agreed collection point at the scheduled lesson time.

If you are late, your instructor may wait for a reasonable period, but the lesson will normally still finish at the originally scheduled time.

If you fail to attend a booked lesson without providing the required notice, the full lesson fee may be payable or deducted from your prepaid lesson balance.

9. Instructor Cancellation

Occasionally, an instructor may need to cancel or rearrange a lesson because of illness, vehicle problems, adverse weather, road conditions, emergencies or other circumstances outside their reasonable control.

Where this happens, we will make reasonable efforts to rearrange the lesson.

You will not be charged for tuition that we cancel and cannot provide.

We are not responsible for indirect losses or expenses resulting from a lesson having to be rearranged where the cancellation results from circumstances outside our reasonable control, subject to your statutory rights.

10. Lesson Duration

Lessons will normally run for the duration stated in your booking.

Lesson time may include appropriate briefing, driving instruction, demonstrations, feedback and a lesson debrief.

Where a lesson begins late because of the instructor, reasonable steps will be taken to provide the full booked lesson duration or otherwise make up the lost tuition time.

11. Collection and Drop-Off Locations

Your normal collection location should be agreed when booking.

Alternative collection or drop-off locations may be possible by prior agreement with your instructor.

Changes to your collection or drop-off location may not always be possible where they would significantly affect lesson timings or the instructor’s following appointments.

12. Driving Tests

Booking driving lessons does not guarantee that your instructor will agree to the use of their tuition vehicle for your practical driving test.

Your instructor will assess your driving ability and may decline use of the vehicle for a test if, in their professional judgement, you are not sufficiently prepared to drive safely and independently to the required standard.

You should discuss your practical test with your instructor before booking or changing a test date wherever possible.

The learner remains responsible for booking, managing and paying for their practical driving test unless explicitly agreed otherwise.

13. Use of the Instructor’s Vehicle for a Driving Test

Use of an instructor’s vehicle for a practical driving test must be agreed in advance.

Additional charges may apply for the instructor’s time, travelling to the test centre, pre-test tuition, vehicle use and return journey.

The vehicle will only be provided where the instructor considers its use appropriate and the learner has demonstrated a suitable standard of driving.

14. Safety During Lessons

Your instructor has responsibility for maintaining a safe learning environment and may give instructions or take control of the vehicle where necessary.

You agree to follow reasonable safety instructions given by your instructor.

An instructor may terminate a lesson if a learner behaves in a dangerous, abusive, threatening or inappropriate manner.

15. Mobile Phones

Mobile phones should not be used by the learner while driving except where their use is lawful, safe and specifically incorporated into the lesson by the instructor.

16. Weather and Road Conditions

Lessons may need to be cancelled or rearranged where weather or road conditions make tuition unsafe.

The final decision regarding whether a lesson can safely proceed rests with the instructor.

Where we cancel a lesson for safety reasons, the affected tuition time will be rearranged or credited as appropriate.

17. Refunds

Requests for refunds for unused prepaid lessons or packages will be considered in accordance with applicable consumer law and the terms that applied when the booking was made.

Lessons that have already been provided are non-refundable.

Any lesson cancelled without the required notice may be deducted from the amount otherwise refundable.

Where a refund is due, it will normally be returned using the original payment method where reasonably possible.

Nothing in these Terms and Conditions affects your statutory consumer rights.

18. Online Purchases and Cancellation Rights

Where lessons or lesson packages are purchased online, by telephone or otherwise at a distance, you may have statutory cancellation rights under UK consumer law.

Where you ask us to begin providing driving tuition during an applicable cancellation period, you may be required to pay for services that have already been provided before you exercise your right to cancel.

Where a service has been fully performed following an appropriate request and acknowledgement from you, your statutory right to cancel may be affected.

Nothing in these Terms and Conditions is intended to restrict any cancellation or refund rights you have under applicable law.

19. Personal Information

We will process personal information provided through the booking system for purposes including managing bookings, providing driving tuition, processing payments, communicating with learners and administering our services.

Further information about how personal information is collected, used and protected should be provided in our Privacy Policy.

20. Instructor Allocation

We will make reasonable efforts to provide lessons with your selected or allocated instructor.

Occasionally, it may be necessary to offer an alternative instructor because of availability, illness, holidays or other operational circumstances.

Where possible, you will be informed of any significant changes to your booking.

21. Instructor Availability

Regular lesson times cannot be guaranteed indefinitely unless specifically agreed.

Instructor availability may change, particularly during busy periods, holidays and around practical driving test dates.

We recommend booking lessons in advance wherever possible.

22. Learner Conduct

We expect learners and instructors to treat each other with courtesy and respect.

Abusive, threatening, discriminatory, aggressive or otherwise unacceptable behaviour will not be tolerated.

We reserve the right to terminate tuition where such behaviour occurs.

23. Liability

We will provide driving tuition with reasonable care and skill.

Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so, including liability that cannot legally be excluded under applicable consumer protection law.

We cannot guarantee that a learner will pass their practical driving test, regardless of the number of lessons taken.

24. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes to our services, booking procedures or legal requirements.

The Terms and Conditions applicable to your booking will normally be those made available to you when the booking is placed, subject to any changes required by law.

25. Governing Law

These Terms and Conditions are governed by the laws applicable in the part of the United Kingdom in which our services are provided.

Nothing in these Terms affects your statutory rights as a consumer.

26. Acceptance of Terms

Before completing an online booking, you will be required to confirm your acceptance of these Terms and Conditions.

By ticking the acceptance box and completing your booking, you confirm that you have read, understood and agree to these Terms and Conditions.
